Probate is the court-supervised process by which assets of a deceased person are identified and gathered to be used for paying the decedent's debts and distributing the remaining balance to the heirs of the estate. A summary administration, also known as small estate administration, has the ability to quickly transfer the assets of the decedent to the appropriate heirs of the estate. To qualify for this type of estate the decedent's assets must either have a value of less than $75,000 (not including the value of the decedent's homestead) or the decedent has been dead for more than two years. If summary administration is not available, the formal administration process is required by the probate court.
